PAD has been conducting a project aimed to promote the study and discussion of democratic thought, foundation and principles, reintegration and development issues. It aims to promote a culture of study and discussion among Nepal’s politically minded adults and youths and eventually help develop new leadership. The program supports to help to deal democratic way in public forums and explain and defend democratic thought and principles in front of a sometimes skeptical public. It has been executing at five different development regions through the support of local partner Ngo’s.
1.1 Issues related to Fundamental Rights and Directives Principle Committee 1. It is difficult for the state to create employment by itself for whole population of the nation. For that reason, government should adopt policy of self employment and establish “youth bank” for providing education and entrepreneurship loan to the youths. A constitutional provision is necessary for it. 2. Youths do have genuine duty and obligation towards their country whom the state have direct investment. . Therefore, he state should adopt a policy of compulsory service towards the country for the candidates who study under state’s scholarship program. 3. Basic education or school education is not enough to catch up with the fast accelerating pace of other nation’s development. Poverty is our harsh reality and people are deprived of education due to it. Therefore, Education should be free up to bachelor level. 4. The state should establish “self-employment development fund” to implement self-employment policy in local level. A constitutional provision can guarantee the effective implementation of it in the policy level. 5. Local skills and conventional employment can be improvised so that people get employment opportunity in the labor market. To achieve it, there should be the provision of providing academic recognition for local employment and skill by providing very basic vocational training packages to the people with Local skills and involved in conventional employment . 6. The educational institutions should be made autonomous to include local contents, skill and art. Constitutional provision guarantees the implementation of it in the policy level. 7. There are certain practices that have international practices concerning child rights, woman rights and human rights. For instance, the maternity leave and facilities of the employees should be according to the international standard, similarly there are other rights that should be implemented according to the international practices and conventions. The constitution should guarantee such practices. 8. The citizenship of a woman should not be cancelled due to marital status. (eg, when a woman marries a foreigner). The entity should have the choice to decide in such condition. The constitution should mention it unambiguously. 9. The state has not been able to make education/ higher education accessible to every citizen who pursue it. Therefore, here should be provision of distance education, informal education and Open University. 10. The school/university curriculum should focus to make its people patriot, disciplined, having respect towards labor, and research oriented. Strict constitutional provision is a must as foreign curricula has been rampantly practiced now. 11. A developing country like Nepal cannot develop themselves by being entirely local or global but a strategy of being “glocal” is indispensable to cope with national and international situation. Therefore, The basic education should be according to the need of the local level and the higher education should be competitive to international level. 12. When women receive credit, they become economic actors with power. Power to improve not only their lives, but, in a widening circle of impact, the lives of their families, their communities and their actions. Hence, suitable measures should be adopted to provide “credit to woman” by the banks to empower woman. 13. Education, health and employment should be fundamental rights to every one. The implementation of it must be made be obligatory by constitutional provision. 14. Provision in the constitution is not enough for its implementation. Therefore, the state must have acts and laws for effective and mandatory execution of fundamental rights. There must be effective mechanism mentioned in the constitution to enforce the provision. 15. Specialized education prepares people required for the development of the country and it is possible through specialization in education. Therefore, the higher education should be based on specialization to prepare human resources necessary for the development of the country and help people be fit for the job market in local, national and international level. 16. The disparity of male and female is rampant. There must be legal provision for equal wage for equal work to men and women that is mentioned in the constitution. There should be clear clause mentioned in the constitution that is possible to implement and achieve it in local and national level as well as in government and non government sector. 17. In order to acquire citizenship and act as reference-basis to provide citizenship to the children/spouse, there should be no discrimination between male and female which must be well defined in the constitution itself. 18. Women suffer sex exploitation at family, home, workplace and market and anywhere. There .must be strong law to stop sex exploitation and the constitution must guarantee it. 19. The reproductive health check up of the woman must be free. 20. There should be guarantee of employment to the people by the state. 21. Student, teachers and parents are very important stakeholders that can improve educational environment. There should be common platform of the student, teachers and parents to create academic environment and it should be made compulsory by law. 22. “It is the duty of the state to provide quality education and the education should be accessible to all” must be mentioned in the constitution. 23. There should be equal rights to parental property between son and daughter. 24. There should be guarantee of fundamental rights to the women of different cultural and social background and it should be made clear by separate laws on it. 25. Sports should be included as fundamental right for UNESCO has declared sports and physical education equal to human right. 26. At least 5% of the university graduates of various faculties must be provided opportunity to work according to their expertise to serve the nation. This shall stop “brain drain” defectively faced by the country. 27. A “Research Fund” must be established in the university for the university students who want to make research studies. 28. A separate act and law must be brought into effect to manage private education and to secure the investment in private education institutions. 29. The education sector must be free from party-based programme, closures and strikes. This must be mentioned clearly in the constitution. 30. The education service commission must be established as constitutional commission 31. There must be provision of unemployment allowance to the people if the state cannot provide the employment to its people. 32. The citizenship certificate should be designed in such a manner that it provides entire identity of the citizen and it serves comprehensive purposes. |
